Now, as far as letters of termination, I want to make two quick points and then I'll add a third one if you need more information. First off, there is no federal law that requires you to provide a letter of termination. However, there are some 15 (actually, I think it's 16) states that have what is called a service letter requirement. In these states, you need to be prepared to provide a very factual, perfunctory type of letter that includes the data of employment for the employee, the date of termination, and the reason for termination. In other words, no unnecessary elaboration or additional information is necessary. The second point I'd like to make is that regardless of whether you're going to provide a letter of termination or not, we strongly recommend that you have a manager, at least one level above the supervisor who is handling the termination, do a complete review to ensure that all your policies are being followed properly. Additionally, if the termination is involuntary, if you all are initiating it, we further strongly recommend that you have legal counsel do a complete review as well in order to avoid unnecessary legal exposure.
